Terms & Conditions

These terms govern your use of the Tippy website and applications.

1. Who we are and acceptance

Tippy is provided by Emanuele Viglianisi, Altenbauerstraße 12, 4060 Leonding, Austria (“we”, “us”). By using the Tippy website or applications, you agree to these terms. If you do not agree, please do not use Tippy.

2. What Tippy is — and is not

Tippy is an informational food logger. It helps you record meals and estimate ingredients, quantities, calories, macronutrients, fiber and glycemic impact from text, photos or barcodes, and it can log meals to your own Nightscout.

Tippy is not a medical device and does not provide medical, nutritional or therapeutic advice, diagnosis or treatment. Estimates come from automated systems and public databases and may be inaccurate, incomplete or unsuitable for your situation. You are responsible for independently verifying all information against product labels or other authoritative sources, in particular before using it for carbohydrate counting, insulin dosing or any dietary or medical decision.

3. Your account

To sync a diary across devices you need an account. You are responsible for the accuracy of the information you provide, for keeping your credentials confidential, and for all activity under your account. You must be old enough to enter into a binding agreement in your jurisdiction and, where required, have the consent of a parent or guardian.

4. Acceptable use

You agree not to misuse Tippy. In particular, you must not attempt to disrupt or overload the service or its AI providers, access it using automated means beyond normal use, reverse-engineer or circumvent usage limits, upload unlawful content, or use Tippy in a way that infringes the rights of others or violates applicable law.

5. Content you submit

You keep ownership of the meal descriptions, photos and other content you submit. You grant us a limited licence to process that content solely to operate the service — for example, to send it to an AI provider for analysis and to store the resulting diary entry. You confirm that you have the right to submit the content and that it does not infringe third-party rights.

6. Subscriptions and payments

Some features may be offered as a paid subscription. Payments are handled by a payment provider (for example Stripe on the web) or by the Apple App Store or Google Play, each under its own terms. Prices, billing period, renewal and cancellation are shown at the point of purchase. Unless stated otherwise, subscriptions renew automatically and can be cancelled through the provider you purchased from.

If you are a consumer in the European Union, you generally have a right of withdrawal for distance contracts. Where a subscription provides immediate access to digital content or services, you may be asked to consent to immediate performance and acknowledge that you lose the withdrawal right once performance has begun. Statutory rights, including rights in respect of defective content, remain unaffected.

7. Availability, changes and termination

Tippy is provided on an “as available” basis. We may add, change, suspend or discontinue features, and may impose fair-use limits, at any time. We may suspend or terminate access if these terms are breached. You may stop using Tippy at any time and may ask for your account and diary data to be deleted.

8. Intellectual property

The Tippy name, logo, interface and software are protected by intellectual-property laws. These terms do not grant you any right to use them except as needed to use the service. Public food data used by Tippy remains subject to the terms of its providers (for example, Open Food Facts data is available under the ODbL).

9. Disclaimers and limitation of liability

To the maximum extent permitted by law, Tippy is provided without warranties of any kind, including accuracy, completeness or fitness for a particular purpose. We do not warrant that estimates are correct or that the service will be uninterrupted or error-free.

To the maximum extent permitted by law, we are not liable for indirect or consequential damages, or for any decision or action taken in reliance on Tippy's estimates. Nothing in these terms limits liability where it cannot be limited by law, including liability for intent or gross negligence, or for death or personal injury caused by our fault. Mandatory consumer rights remain unaffected.

10. Governing law and contact

These terms are governed by Austrian law, without prejudice to the mandatory consumer-protection rules of your country of residence. Questions about these terms can be sent to emavgl.app@gmail.com.
